Motions practice is helpful and has been successful in Abusive Head Trauma cases. Participants in this workshop will learn the current state of the law regarding admissibility of scientific evidence and legal principles that are effective in preventing the defense from presenting theories not based in science and reason. Participants will also learn how to present these arguments before the court, both in oral and written arguments. The workshop will also cover effective cross-examination of the defense expert to highlight the flaws in their theories and qualifications as an expert. This workshop will only be recorded and available On-Demand from August 9, 2021 until December 17, 2021.
Upon completion, the participant will understand the application of the Daubert (and other) standards to defense arguments in Abusive Head Trauma cases
Upon completion, the participant will have a greater understanding of the science asscoiated with Abusive Head Trauma and how to effectively communicate that knowledge to the trier of fact
Upon completion, the participate will understand the importance of meeting your burden in a Daubert hearing, and the perils of failing to do so on appeal
Upon completion, the participant will learn techniques to successfully voir dire the defense expert and challenge their qualifications and credibility
